Unsocial HoursAgenda for Change · Section 2 · England

What Section 2 owed you, line by line.

Night, weekend and bank holiday enhancements are set by Section 2, and the rules have edges that are easy to miss — including one that can qualify a whole shift rather than just the hours after 20:00. Put last month’s shifts in and compare it with your payslip.

Paragraph 2.11, the one most people miss

Weeknight 19:00 → 07:30 · Band 5 · £18.50/hr · 12.5h

Counting only the hours after 20:0010h at +30%£55.50
More than half the shift is between 8pm and 6am, so all of it counts12.5h at +30%£69.38
Difference on one shift£13.88

Whether your payslip applied this is worth checking. If the same weeknight is in your rota every week, the difference repeats.

An end time earlier than the start means the shift runs past midnight. Enter the date the shift started.

What you were paid

On most payslips this is a separate line, often shown as “Unsocial Hours” or “Enhancements”. Enter the enhancement only, not your whole net pay.

How this is worked out

Hours workedBand 4–9
Saturday and weeknights 20:00–06:00midnight to midnight on Saturday+30%
Sunday and public holidaysmidnight to midnight+60%
Everything elsebasic rate, no enhancement

Bands 1, 2 and 3 are paid at higher percentages: +47/94%, +41/83% and +35/69%. Bands 8a to 9 are on the same +30/60% as band 4.

Three paragraphs of Section 2 do the work. 2.10 sets the windows: column 2 for all unsocial hours on a Saturday, midnight to midnight, and on weekdays between 8pm and 6am; column 3 for all hours on Sundays and public holidays, midnight to midnight. 2.11 qualifies a whole continuous night or evening shift on a weekday for column 2, where more than half of it falls between 8pm and 6am. 2.12 allows one rate per hour worked, so where two windows meet the higher rate applies and nothing stacks. A shift running from Saturday into Sunday therefore changes rate at midnight.
